Acceptance of Terms

These Terms of Service govern your access to and use of Kiara Spicy, including the website, account system, dashboard, credit purchases, AI chat assistant, voice assistant, model catalog, uploads, image and video generation, library, public creations, APIs, workflow lanes, and related services.

By accessing or using Kiara Spicy, you agree to these Terms, the Privacy Policy, Refund Policy, Cookie Policy, and Acceptable Use Policy. If you do not agree, do not use the service.

Kiara Spicy is in beta. Features, prices, model names, model availability, output quality, safety rules, payment methods, and dashboard controls may change.

Adults Only

• You must be at least 18 years old to use Kiara Spicy.
• If your location requires a higher age to access adult content or AI adult-content tools, you must meet that higher age.
• You must not use the service if viewing or creating adult AI content is illegal where you live.
• You must not upload, request, generate, edit, publish, or share content involving minors or age-ambiguous people in sexual, suggestive, exploitative, nude, fetish, or romantic contexts.

We may suspend accounts, delete content, block generations, refund credits, deny refunds, and report content when child-safety or exploitation concerns appear.

What Kiara Spicy Provides

Kiara Spicy provides access to Kiara-branded AI creation lanes for images, video, edits, enhancements, prompt assistance, and voice/chat support. Some lanes are powered by third-party model, workflow, voice, infrastructure, search, and payment providers.

The service may include text-to-image, image-to-image, reference-guided generation, video generation, image enhancement, relighting, face-oriented workflows, character workflows, prompt construction, model selection tools, public galleries, and private libraries.

• We may brand model lanes under Kiara names to keep the product simple.
• Provider routing, workflow ids, node ids, backend urls, API keys, internal prompts, and infrastructure details are confidential.
• Generated outputs are probabilistic and may vary across attempts, even with the same prompt.
• AI outputs may contain mistakes, artifacts, unwanted details, blocked content, style drift, or content that needs human review before use.

Accounts and Security

• You are responsible for your account, device, email, Telegram account, Google account when enabled, wallet, and any activity under your session.
• Do not share your login session, abuse another user account, bypass authentication, scrape private content, automate abuse, or attempt to access admin, provider, or backend systems.
• We may require re-authentication, invalidate sessions, rate-limit requests, suspend accounts, or block access when we detect abuse, security risk, payment risk, or policy violations.
• You must provide accurate account and payment information where requested.

Credits, Subscriptions, and Pricing

Kiara Spicy uses credits for generation and model access. The current internal rate is 1 credit = USD $0.01 for price display and ledger accounting, but credits are not money, stored value, a bank balance, a gift card, or a cash equivalent.

• Credits are non-transferable and can be used only inside Kiara Spicy.
• One-time credit packs are intended not to expire while your account remains in good standing, unless law, fraud, abuse, account termination, or service shutdown requires otherwise.
• Subscription credits are granted for the subscription period and may expire after 30 days or the period shown at purchase.
• Generation costs depend on model, duration, resolution, quality, audio, references, and other settings.
• A generation can debit credits before submission. Eligible system, provider, content-filter, no-output, or save failures may trigger credit refunds as described in the Refund Policy.
• Prices, credits, package names, bonus credits, subscription terms, and supported payment methods may change prospectively.

Payments

Payment methods may include crypto invoices through Plisio and card payments through Stripe or another card processor if enabled. The dashboard may show only the methods currently available for your account and region.

• Crypto transactions are blockchain transactions. Network fees, wallet mistakes, chain congestion, exchange-rate movement, wrong-chain transfers, and third-party wallet issues are outside our control.
• Card processors may apply their own terms, risk checks, fraud screening, identity checks, disputes, chargebacks, and data processing.
• We may delay credit grants while payment confirmation, webhook verification, fraud review, or provider reconciliation is pending.
• Chargebacks, fraudulent payments, payment reversals, or abuse of refund systems may result in account suspension or credit removal.

Your Content and Generated Outputs

You keep whatever rights you already have in prompts, uploaded references, and other content you provide. You are responsible for having the rights, consent, releases, and lawful basis needed to upload or use that content.

To the extent allowed by applicable law and provider terms, Kiara Spicy grants you the rights it has in the generated outputs created through your account. You are responsible for reviewing outputs before publishing, selling, distributing, or using them commercially.

• By uploading content, you give Kiara Spicy and its providers permission to host, copy, transform, transmit, analyze, moderate, process, cache, and display it as needed to provide the service.
• If you publish content to a public gallery, share page, feed, or social channel, you allow us to display, cache, resize, transcode, promote, and distribute that public content in connection with Kiara Spicy.
• You must not claim that AI-generated content is real footage or a real photograph when that would mislead people, violate law, or harm someone.
• You must not use another person's likeness, private image, brand, copyrighted work, or trademark in a way that violates law or rights.

Acceptable Use

You must follow the Acceptable Use Policy. That policy is part of these Terms and controls what is allowed and prohibited on Kiara Spicy.

• Adult AI content may be allowed only when it involves consenting adults, lawful use, and no prohibited themes.
• We prohibit minors, non-consensual intimate content, sexual deepfakes of real people without consent, exploitation, coercion, harassment, doxxing, illegal activity, rights violations, payment fraud, platform abuse, and attempts to bypass safety systems.
• Provider rules may be stricter than Kiara Spicy rules. A provider may reject, filter, or block a request even when Kiara Spicy accepts the submission.

Third-Party Providers

The service depends on third-party infrastructure, model, workflow, voice, payment, authentication, email, storage, and security providers. Your use of features may be subject to their policies and technical limitations.

• Providers may process prompts, uploads, references, generated outputs, audio, tool calls, payments, login information, abuse signals, or request metadata when necessary for the feature.
• Providers may change pricing, model availability, rules, safety behavior, latency, retention, or output behavior. We are not responsible for provider outages, restrictions, or policy changes.
• We may replace or add providers without notice, as long as the change is reasonably consistent with these Terms and the Privacy Policy.

Beta Features and Availability

• Kiara Spicy is provided on an as-available basis.
• We do not guarantee uninterrupted uptime, fixed render times, fixed queue times, fixed model availability, fixed output quality, or permanent access to any specific model.
• We may throttle, queue, pause, remove, rename, test, or disable features at any time for maintenance, safety, costs, provider limits, abuse prevention, or product changes.
• Some features may show coming-soon states, be limited to certain accounts, or require additional verification.

Refunds

Refund rules are described in the Refund Policy. In short: eligible technical failures may receive automatic credit refunds, but completed digital credit purchases and successful generation attempts are generally final unless applicable law requires otherwise.

IP, Likeness, and Safety Complaints

To report copyright, trademark, likeness, privacy, non-consensual intimate content, or safety concerns, contact kacinka74@gmail.com. Include the URL, your relationship to the content, what right is affected, and enough information for us to review the claim.

We may remove or restrict content while we investigate. False, abusive, or bad-faith complaints may result in account action.

Suspension and Termination

• We may suspend, limit, or terminate access if you violate these Terms, fail age requirements, misuse payments, abuse tools, threaten the service, break provider rules, or create legal/safety risk.
• We may remove content, block uploads, block generations, cancel pending tasks, invalidate sessions, revoke credits, or preserve evidence where needed for safety, fraud, compliance, or legal defense.
• You may stop using the service at any time and request account deletion under the Privacy Policy.

Disclaimers

The service is provided "as is" and "as available" to the fullest extent allowed by law. We do not promise that the service will be uninterrupted, error-free, secure, compatible with every device, lawful for every use, or that outputs will meet your expectations.

We are not responsible for user prompts, user uploads, user-published content, third-party provider behavior, wallet errors, blockchain fees, external platforms, or how you use generated outputs outside Kiara Spicy.

Limitation of Liability

To the fullest extent allowed by law, Kiara Spicy, Kiara Intelligence, operators, contractors, and service providers will not be liable for indirect, incidental, special, consequential, punitive, exemplary, lost-profit, lost-data, reputational, business-interruption, or substitute-service damages.

To the fullest extent allowed by law, our total liability for any claim related to the service will not exceed the amount you paid to Kiara Spicy for the service feature giving rise to the claim during the three months before the event, or USD $100, whichever is greater.

Some jurisdictions do not allow certain limitations. In those places, the limitation applies only to the maximum extent permitted by law.

Indemnity

You agree to defend, indemnify, and hold harmless Kiara Spicy, Kiara Intelligence, operators, contractors, and providers from claims, losses, damages, liabilities, costs, and expenses arising from your content, your use of outputs, your violation of these Terms, your payment abuse, your violation of law, or your violation of another person's rights.

Applicable Law and Disputes

Kiara Spicy is operated from the Netherlands. The operator is registered with the Netherlands Chamber of Commerce (KVK). Company registration details will be published on this page when the production legal entity is finalized.

These Terms do not limit consumer rights that cannot be waived under your local law. Where a mandatory local law applies, that law controls only to the extent required.

Where no mandatory local rule applies, these Terms are governed by Dutch law and any dispute shall be submitted to the competent courts of Amsterdam, the Netherlands.

Changes to These Terms

We may update these Terms as the product, laws, providers, payment systems, pricing, safety rules, or business structure changes. Continued use after the updated date means you accept the updated Terms.
